Terms and Conditions and Instructions
Article 1 - definitions
in these terms and conditions, the following definitions apply:
cooling-off period: the period within which the consumer can exercise the right of withdrawal.
consumer: the natural person who is not acting in the course of a profession or business and who enters into a distance contract with the entrepreneur.
day: calendar day.
duration transaction: a distance contract relating to a series of products and/or services where the delivery and/or purchase obligation is spread over time.
durable data carrier: any means that enables the consumer or entrepreneur to store information personally addressed to them in a way that allows future consultation and unchanged reproduction.
right of withdrawal: the option for the consumer to cancel the distance contract within the cooling-off period.
entrepreneur: the natural or legal person offering products and/or services to consumers at a distance.
distance contract: a contract concluded within an organised system for distance selling of products and/or services, using only one or more means of distance communication up to and including the conclusion of the contract.
means of distance communication: tools that can be used to conclude a contract without the consumer and entrepreneur being physically present in the same place at the same time.
general terms and conditions: the current terms and conditions of the entrepreneur.

Article 3 - applicability
these general terms and conditions apply to all offers from the entrepreneur and to all distance contracts and orders between the entrepreneur and the consumer.
before the contract is concluded, the text of these terms will be made available to the consumer. if this is not reasonably possible, it will be indicated where the terms can be viewed and that they will be sent free of charge upon request.
for electronic contracts, the terms may be made available in a way that allows them to be stored on a durable data carrier.
if one or more provisions are found to be invalid, the remaining provisions remain fully in force.
Article 4 - the offer
the offer contains a complete and accurate description of the products and/or services offered. obvious mistakes or errors do not bind the entrepreneur. images are indicative and cannot give rise to rights.
each offer contains sufficient information about:
- price including taxes
- any shipping costs
- how the contract is formed
- whether or not the right of withdrawal applies
- payment, delivery and performance
- validity period of the offer
- communication costs where applicable
- archiving of the contract
- how data can be checked or corrected
- any other languages in which the contract may be concluded
- applicable codes of conduct if any
- minimum duration of the contract if applicable
Article 5 - the agreement
the agreement is concluded when the consumer accepts the offer and meets the conditions. in case of electronic acceptance, the entrepreneur immediately confirms receipt.
the entrepreneur may refuse an order or impose additional conditions if there are valid reasons.
Article 6 - right of withdrawal
the consumer may withdraw from a purchase of products within 30 days without giving any reason. the period starts the day after receipt of the product.
the consumer must handle the product and packaging with care and only unpack or use it to the extent necessary to assess it.
to exercise the right of withdrawal, the consumer must notify the entrepreneur within 30 days of receiving the product by email. the product must then be returned within 14 days. proof of shipment is required.
Article 7 - costs of withdrawal
return shipping costs are borne by the consumer. any payments made will be refunded within 14 days after withdrawal, provided the product has been received or proof of return has been provided.
Article 8 - exclusion of the right of withdrawal
the right of withdrawal may be excluded for:
- custom-made products
- personalised products
- perishable goods
- sealed hygiene products where the seal has been broken
- services already started with consumer consent
- certain travel or leisure services on a specific date
Article 9 - price
prices will not be increased during the validity period of the offer, except in case of VAT changes. variable prices may fluctuate due to external market conditions.
Article 10 - conformity and warranty
products must comply with the agreement and reasonable expectations. defects must be reported within 14 days. warranty does not apply in case of improper use or modification by third parties.
Article 11 - delivery
delivery takes place within 30 days to the address provided by the consumer, unless otherwise agreed. in case of delay, the consumer will be informed and may cancel the agreement.
Article 12 - duration of agreements
ongoing agreements may be terminated with a notice period of up to one month. tacit renewal is limited according to the conditions.
Article 13 - payment
payments must be made within 7 working days. in case of non-payment, reasonable collection costs may be charged.
Article 14 - complaints
complaints must be submitted within 7 days. the entrepreneur will respond within 14 days or indicate a longer processing time if necessary.
Article 15 - disputes
all agreements are governed exclusively by dutch law, even if the consumer resides abroad.
